Kinderwunschzentrum - Charta der guten Praktiken

A. Ziel der Charta

Der Zweck dieser Charta besteht darin, die Vertraulichkeit, die Unparteilichkeit und das ethische Verhalten im
Kinderwunschzentrum des CHL zu gewährleisten.

B. Geltungsbereich

Diese Charta gilt für alle Mitglieder des Kinderwunschzentrums, unabhängig von ihrer Berufskategorie oder der
Art ihres Vertrags (Angestellte, Mitarbeiter, Freiberufler, Auszubildende und Praktikanten). Dies gilt in den sie
betreffenden Punkten auch für Personen, die einmalige Aufgaben (wie Installationen, Wartungsarbeiten,
Reparaturen usw.) im Kinderwunschzentrum durchführen. Alle diese Personen werden als „Beteiligte“
bezeichnet.

C. Grundsätze

1. Alle Beteiligten im Kinderwunschzentrum sind verpflichtet

• die Bestimmungen der Allgemeinen Verordnung des CHL einzuhalten,
• ihre Aufgaben gemäß den Anforderungen der gesetzlichen, behördlichen und normativen Texte, insbesondere der Norm ISO 15189:2022, wahrzunehmen,
• sich jeder Handlung zu enthalten, die die Betriebsintegrität des Zentrums oder das Vertrauen seiner Kunden beeinträchtigen könnte,
• die Patienten gerecht, unparteiisch und ohne Diskriminierung zu betreuen, im Einklang mit den internen Vorschriften des Zentrums,
• biologische Proben sorgfältig und unter Beachtung der internen Standardverfahrensanweisungen zu behandeln,
• die Privatsphäre jedes Einzelnen, die Vertraulichkeit der erhobenen Daten und aller Informationen, die der Geheimhaltungspflicht unterliegen, zu respektieren,
• die Vertraulichkeit aller Patienteninformationen zu wahren, unabhängig von ihrer Quelle.

2. Das Kinderwunschzentrum gewährleistet in Zusammenarbeit mit der IT-Abteilung des CHL den Schutz der archivierten klinischen Daten sowie die Kontrolle des Zugriffs auf diese Daten. Es werden keine personenbezogenen Daten über die Aktivitäten des Zentrums veröffentlicht. Die Weitergabe medizinischer Informationen an andere Gesundheitsdienstleister erfolgt ausschließlich auf Anfrage der betroffenen Patienten.

3. Das Kinderwunschzentrum unterliegt keinem Druck, der sein Urteil oder die Qualität seiner Arbeit beeinträchtigen könnte. Es widersetzt sich daher jeglichem kommerziellen oder finanziellen Einfluss, indem es bei der Auswahl und dem Einkauf von Geräten, Reagenzien und Verbrauchsmaterialien ausschließlich objektive Kriterien, im Interesse der Patienten benutzt. Ebenso lehnt das Zentrum jeglichen unangemessenen Druck seitens seiner Klienten ab, indem es die in den internen Vorschriften festgelegten Zugangsbedingungen zur assistierten Reproduktion strikt einhält und die Kontrolle über die bereitgestellten Ergebnisse und deren Interpretation behält. Das Kinderwunschzentrum verpflichtet sich, etwaige Interessenkonflikte offen zu legen, sofern dies der Fall ist.

4. Mit ihrer Unterschrift, handschriftlich oder elektronisch im Ennov, erklären die Unterzeichner dieser Charta

• sich an alle oben genannten Grundsätze zu halten und sich zu verpflichten, diese anzuwenden,
• keinen Interessenkonflikt in Bezug auf die Aktivitäten des Kinderwunschzentrums zu haben,
• sich zu verpflichten, alle möglicherweise auftretenden Interessenkonflikte unverzüglich zu melden.

5. Jeder Verstoß gegen diese Charta wird mit einer Nichteinhaltungserklärung geahndet.

Fertility Center - Charter of good practices

A. Purpose of the Charter

The purpose of this charter is to ensure confidentiality, impartiality, and ethical conduct at the CHL Fertility Center.

B. Scope of Application

This charter applies to all members of the CHL Fertility Center, regardless of their professional category or the nature of their contract (employees, development workers, freelancers, apprentices, and interns). It also applies, in matters that concern them, to individuals who perform occasional assignments (installation, maintenance, repairs, etc.) at the Fertility Center. All of these individuals are referred to as "stakeholders."

C. Principles

1. All stakeholders of the Fertility Center undertake

• to comply with the provisions of the CHL's general regulations,
• to perform their duties in accordance with the requirements of legal, regulatory, and normative texts, in particular those of ISO 15189:2022,
• to refrain from any action likely to affect the operational integrity of the Center or the trust of its clients,
• to care for patients fairly, impartially, and without discrimination, in accordance with the provisions of the internal regulations,
• to handle biological samples with care and in compliance with internal standard operating procedures,
• to respect the privacy of each individual, the confidentiality of the data collected, and any information subject to professional secrecy,
• to maintain the confidentiality of all patient information, regardless of its source.

2. The Fertility Center, in collaboration with the CHL IT department, guarantees the protection of archived clinical data and controls access to this data. It will not make any personal data concerning its activities public. Medical information will only be shared with other healthcare providers at the request of the patient concerned.

3. The Fertility Center is free from any pressure that could alter its judgment or the quality of its work. It therefore opposes any commercial or financial influence, by adopting a policy for the selection and purchasing of equipment, reagents, and consumables based exclusively on objective criteria and in the best interest of patients.

Similarly, the Fertility Center rejects any undue pressure from its clients, strictly respecting the conditions of access to assisted reproduction defined in the internal regulations and retaining control over the results provided and their interpretation. The Fertility Center undertakes to openly declare any conflict of interest should this be the case.

4. By signing this charter, whether handwritten or electronic in Ennov, the signatories:

• adhere to all the principles set out above and undertake to apply them,
• declare that they have no conflict of interest related to the activities of the Fertility Center,
• undertake to promptly report any source of conflict of interest that may subsequently arise.

5. Any breach of this charter will be subject to a declaration of non-compliance.

Centro de Fertilidade - Carta de boas práticas

A. Objetivo da Carta

O objetivo desta carta é garantir as condições de confidencialidade, imparcialidade e conduta ética no Centro de
Fertilidade.

B. Ârea de aplicação

Este estatuto aplica-se a todos os membros do Centro de Fertilidade, independentemente da sua categoria profissional ou da natureza do seu contrato (funcionários, voluntários, freelancers, aprendizes e estagiários).

Aplica-se também, para os pontos que lhes dizem respeito, às pessoas que realizam missões pontuais (instalação, manutenção, reparação, etc.) no Centro de Fertilidade. Todas estas pessoas são chamadas de “partes interessadas”.

C. Princípios

1. Todos os intervenientes no Centro de Fertilidade estão empenhados

• cumprir com as disposições do regulamento geral do CHL,
• exercer as suas funções de acordo com os requisitos dos textos legais, regulamentares e normativos, em especial os da norma ISO 15189:2022,
• abster-se de qualquer ação suscetível de alterar a integridade operacional do serviço ou a confiança dos seus clientes,
• cuidar dos doentes de forma justa, imparcial e sem discriminação, de acordo com as disposições do regulamento interno,
• tratar as amostras biológicas com cuidado e em conformidade com os procedimentos internos e métodos operacionais,
• respeitar a privacidade de cada indivíduo, a confidencialidade dos dados recolhidos e de qualquer informação sujeita a segredo profissional,
• manter a confidencialidade de todas as informações do doente, independentemente da sua fonte.

2. O Centro de Fertilidade, em colaboração com o departamento de informática do CHL, garante a proteção dos dados clínicos arquivados, bem como o controlo do acesso a esses dados. Não tornará públicos quaisquer dados pessoais relativos às suas atividades. A comunicação de informações médicas a outros prestadores de cuidados de saúde só será feita a pedido do doente em causa.

3. O Centro de Fertilidade está livre de qualquer pressão que possa alterar o seu discernimento ou a qualidade do seu trabalho. Assim, opõe-se a qualquer influência comercial ou financeira, tendo uma política de seleção e aquisição de equipamentos, reagentes e consumíveis baseada exclusivamente em critérios objetivos e no interesse dos doentes. Da mesma forma, o Fertility Center recusa qualquer pressão indevida por parte dos seus clientes, respeitando rigorosamente as condições de acesso à PMA definidas no regulamento interno e mantendo o controlo dos resultados fornecidos e da sua interpretação. O Centro de Fertilidade compromete-se a declarar abertamente qualquer conflito de interesses, caso este ocorra.

4. Os signatários da presente carta, através da sua assinatura, manuscrita ou eletrónica em Ennov,

• aderir a todos os princípios acima estabelecidos e comprometer-se a aplicá-los,
• declaram não ter qualquer conflito de interesses relativamente às atividades do Centro de Fertilidade,
• comprometer-se a comunicar sem demora qualquer fonte de conflito de interesses que possa posteriormente surgir.

5. Qualquer violação desta carta estará sujeita a uma declaração de não conformidade.
